Ashwini Vaishnav, Union Minister for Communications, Electronics and Information Technology, introduced the Digital Personal Data Protection Bill 2023 in the Lok Sabha. The Bill lays down the responsibilities of entities handling and processing digital data while upholding the rights of individuals in law.
Purpose of the Digital Personal Data Protection Bill
The primary objective of the Digital Personal Data Protection Bill, 2023 is to establish a comprehensive framework for the protection of personal data. The framework extends its jurisdiction to personal data collected within India, both online and offline data that has subsequently been digitised.
Highlights of the Digital Personal Data Protection Bill
- The Bill provides for processing of digital personal data in a manner that recognizes both the right of individuals to have their personal data protected and the need to process such personal data for legitimate purposes.
- According to the Bill, a person can process personal data of an individual for a legal purpose based on their consent and for certain lawful uses.
- The Bill provides for the establishment of the Data Protection Board of India. In case of personal data breach, the Board will investigate the matter and impose penalty.
- While determining the amount of monetary penalty to be imposed, the Board shall consider the nature, seriousness and duration of the breach and the type and nature of personal data affected by the breach.
- The Bill states that individuals have the right to rectification, completion, updating and erasure of their personal data, to which they have previously given consent.
- According to the Bill, a penalty of Rs 250 crore can be imposed in case of a breach in complying with the obligation of the data fiduciary of personal data.
